RULES AND REGULATIONS

Guidelines to Keep Our Community Safe and Welcoming



The Association, acting through its Board of Directors, endeavors to maintain the unified building scheme that presently exists in Hunter’s Grove community, as well as the first-class appearance and market value of the homes and lots, in accordance with the Declaration of Protective Covenants, Conditions and Restrictions for Hunter’s Grove. In order to achieve this goal, the Board of Directors hereby adopt the following Rules and Regulations for Hunter’s Grove community, on the date and time referenced below.




These Rules and Regulations are meant to supplement the Declaration.

Please refer to the Declaration for the complete and comprehensive restrictions.

USE OF THE RESIDENCE

Each Lot in Hunter’s Grove is limited to single-family use as a single-family residence (even when leasing). “Single-family residence” shall mean all households, including rentals, must be for the use of one (1) family unit or single household; no multi-family use or room rentals are allowed. A “family” as used herein shall mean any persons related by blood, marriage, adoption, fostering or otherwise considering themselves to be related or belonging to the same unit of person commonly referred to as a family.


The owner, or if the Lot is managed by a property manager or management company, must oversee tenants, maintenance, and repairs of the Home and Lot. Tenancy information must be provided to the Association prior to a lease and copy of the Association's governing documents must be returned signed to the association.

PETS & PET POLICIES

  1. Household pets may be kept provided they do not become a nuisance, in the sole discretion of the Board of Directors.
  2. Owners must clean up all droppings by pets and dispose of droppings in the pet owner’s garbage receptacle.
  3. Pets must be maintained and controlled on a leash at all times while outside the Home and Lot.
  4. No pet may be chained or tied up unsupervised on a Lot.
  5. If you have a fence, it must be secure so as not to allow pets to get loose.




UNSIGHTLY OBJECTS

No unclean, unsightly, or unkept conditions are permitted on any lots. No hanging laundry is allowed outside of the dwelling unless in compliance with Chapter 720, Florida Statutes.




GARBAGE & RECYCLING GUIDELINES

  1. No garage accumulation is allowed on the property.
  2. All garbage must be placed in appropriate receptacles and hidden from view in the garage, or backyard behind a fence or adequate shrub.
  3. On trash collection days, waste receptacles must be placed at the curb the evening before the collection day or no later than 6:00 a.m. on collection day.
  4. Trash receptacles must be removed from the front of the premises/curb and stored according to these Rules by 6:00 p.m. on collection day.
  5. On trash collection days, trash receptacles must be placed at the curb at least 3 feet apart and at least 3 feet from other objects, such as the mailbox.
  6. Place bins with arrows towards the street.
  7. No hazardous waste, electronics, or batteries of any kind may be placed in trash receptacles.
  8. Contact the Board of Directors if you have white good/bulk garbage that requires visibility for any length of time.
  9. Contact the Board of Directors if you will be away and bins will be out longer than permitted.
  10. Do not overfill bins or pack them tightly, to ensure items do not get stuck in the bins. Overfilled bins will not be picked up.
  11. Do not place plastic bags in recycle bins. Always breakdown cardboard boxes before placing them in the recycle bin.




YARDS AND YARD WASTE

  1. Keep lawns tidy; no bare areas of vegetation are allowed. No unsightly weeds, underbrush or growth shall be permitted to grow or remain.
  2. Lawns must be kept mowed and clear of debris and unsightly vegetation.
  3. Failure to maintain lawns and landscaping shall be deemed to impair the value of the other lots within the Association.
  4. Yard waste may not be placed in plastic bags. Use paper bags, reusable containers or tied bundles.




TREES

No trees measuring six (6) inches or more in diameter at a point two (2) fee above ground level may be removed without the written approval of the Board of Directors.


Approval must be sought to remove trees in the front of a residence or within 10 feet of the residence, in order to determine if removal will substantially decrease the aesthetics of the property or the community.




COMMON AREAS

No person may use any portion of the common area in a manner which abridges the equal rights of all other owners. Any usage of common areas must be approved by the Board in writing and deemed fair to all other owners. Residents may not have exclusive use of any common areas.




PARKING

The following vehicles are not allowed unless they are stored completely out of sight of other residents:

  1. Commercial vehicles
  2. Semi-trucks
  3. Buses
  4. Boats, jet-skis, other recreational vehicles, and trailers
  5. Campers
  6. Mobile homes
  7. Motor homes




COMMERCIAL VANS

  1. Parking of vehicles in front or side yards overnight is prohibited.
  2. Parking on landscaping, lawns, or grass is prohibited.
  3. Recreational vehicles are permitted temporary parking for a maximum of 48 hours, as long as they are not obstructing the road.
  4. Overnight street parking is prohibited by Manatee County ordinance. Contact the Board of Directors if you are having guests for a limited period of time.
  5. Temporarily street-parked vehicles must park with the flow of traffic.
  6. Parking of vehicles on common areas, sidewalks, or blocking sidewalks or driveways is prohibited.
  7. Comply with Manatee County ordinances (Must be parked facing direction of traffic only, and cannot be directly across from another street parked car.
  8. Any vehicle parked in violation of these restrictions may be towed at the Owner’s expense.




GOLF CARTS

  1. Operation of any golf cart within the Hunter’s Grove Subdivision shall in accordance with all local and state laws.
  2. Golf carts may only be operated in the Subdivision between sunrise and sunset, unless the golf cart is equipped with headlights, brake lights, turn signals, and a windshield.
  3. All golf carts operated in the Subdivision must be equipped with efficient brakes, a reliable steering apparatus, safe tires, a rearview mirror, and red reflectorized warning devices in the front and rear, the sufficiency of which is within the discretion of the Board of Directors.
  4. All golf carts must be registered with the Association prior to use in the Subdivision.
  5. No golf cart may be operated in an unsafe, disorderly, or unlawful manner, or in a manner that creates a disturbance, nuisance or annoyance to the Subdivision or any residents or other persons in the Subdivision, in the sole discretion of the Board of Directors.
  6. Any violation of this Rule will be subject to all actions and remedies available to the Association pursuant to the Declaration and/or state law.
  7. The Board of Directors also encourages golf cart users to obtain insurance on their golf carts, and to be aware and reminded of the liability, risks and ramifications of golf cart usage, especially by minors.




TEMPORARY STRUCTURES

No temporary structures or outbuildings of any type are permitted upon any Lot except those utilized by approved contractors in connection with construction that has been pre-approved by the Architectural Review Committee or the Board of Directors. Such permitted temporary structures may not at any time be used as residences or permitted to remain on the property after completion of construction.

  1. No sheds are allowed.
  2. No Tents are allowed
  3. No above-ground pools are allowed as they are considered temporary structures and can become harmful in the event of a hurricane.




FENCES

  1. Fences, walls, and hedges not in excess of six (6) feet in height are permitted in accordance with Section 15 of the Declaration and must be PRE-APPROVED by the Board of Directors.
  2. Fences must be maintained by the owner of the Lot in good working order and in a sightly, clean, and workable condition.
  3. Fences cannot become a nuisance by decay or lack of maintenance, in the sole discretion of the Board of Directors.




LAMPS

All front yard lamps must be in good working order and condition. Front yard lamps must be lit at all times as they serve as street lighting. Non-working lamps shall constitute a nuisance.




NUISANCE

  1. No Lot, parcel, or land may become a nuisance in the sole discretion of the Board of Directors.
  2. No nuisance behavior is permitted, including any loud or objectionable noises, or harassment or profanity directed toward residents or Association management.
  3. Please be considerate of your neighbors.




LAWS

The use of any home cannot violate any local, state, or federal laws or regulations.




ANTENNAS

No exterior radio, television or other communication system antennas are allowed. Additionally, no internal radio, television or other communication system antennas are allowed that create interference with a neighbor’s reception.




HAZARDS

No Owner is permitted to do anything that may create any type of safety hazard for anyone else or other properties. For example, no burning of trash/garbage is allowed. (This excludes enclosed fire pits burning wood only).




SIGNS

No exterior signs are allowed except those listing a home for sale or indicating the name of the residents. Any such signs must comply with the

specifications included in Article IV, Section 7 of the Declaration.





HURRICANE PREPAREDNESS

In preparation for any tropical storm or hurricane, please remove and store all loose objects

that are not affixed to the land from the exterior of the home.




HURRICANE PROTECTION REQUIREMENTS/SPECIFICATIONS

All new hurricane protection installed within the Association must conform to the standards below, in addition to complying with the existing unified building scheme that exists within our Association, and the color palate existing within the Association.


Roof Systems: No roof systems are allowed within the Association other than the present existing roofing schemes.


Permanent Fixed Storm Shutters: New Accordion Shutters may be installed in Association upon approval by the Architecture Review Committee. They must conform to the existing unified building scheme of the home and within the Association, including the color palate of the dwelling.


Roll down track storm shutters. A homeowner may install roll down track storm shutters upon approval by the Architecture Review Committee. Such shutters shall consist of metal that matches the color of the dwelling or its trim exactly.


Impact resistant windows and doors. The Association strongly encourages the installation of impact-resistant windows and doors. If installed, they must conform to the existing unified building scheme of the home and the Association, including the color palate of the dwelling.


Reinforced garage doors. The Association strongly encourages the installation of reinforced garage doors. However, any reinforced garage door installed must conform to the unified building scheme of the home and within the Association, including the color palate of the dwelling.


Erosion controls. Synthetic underground erosion control mats and overground erosion control blankets that interfere with irrigation shall not be permitted. Bio-degradable or dissolvable natural erosion control mats of coconut fiber or jute may be utilized, provided the mat is not visible from the frontage of the parcel, an abutting parcel or abutting common area.


Exterior fixed generators. Any new exterior fixed generator can be installed upon approval by the Architecture Review Committee and must be screened from view of the street and neighboring property.


Other hurricane protection products allowed. Hurricane protection fabric, corrugated metal panels and roller screens shall be permitted only as follows: Metal and fabric fasteners may be installed year-round, but the

fabric or corrugated metal panels themselves must only be attached during an issued hurricane warning and removed within 7 days of the end of warning period.


Other hurricane protection products prohibited: From the date these specifications are adopted by the Association, no other visible hurricane protection products, other than those specifically permitted by this Hurricane Protection Specification shall be installed within the Association. Without the written consent of the Architecture Review Committee and the Association Board of Directors.
